Appeal Hearing

The Appeal only takes place if it is made (appendix 6) in writing by the disciplined employee, stating the grounds upon which the appeal is based, within the time limits.

A manager not previously involved in the investigations or the disciplinary hearing should chair the appeal. The Manager holding the Appeal should introduce everyone, explain the role of all concerned and also ensure that everybody understands the ground(s) for the Appeal.

This information should be addressed to the Manager hearing the Appeal, who asks questions to clarify the information provided by both parties and to understand all the factors and circumstances.

If the Manager hearing the Appeal is satisfied that all new factors have been presented by the employee (or Union Representative/colleague where appropriate), the Appeal is adjourned.

After due consideration, the hearing is reconvened. The Manager hearing the Appeal should then verbally give the result of the appeal to the individual along with explanation of the decision. The employee is then informed of the Manager's decision in writing (appendix 8), stating only whether or not the Appeal stands.
